Termination or restriction of services or facilities

What you should know:

  • landlord can not withdraw or restrict essential service if the service is included in your tenancy agreement
  • landlord may terminate or restrict non-essential services or facility by giving 30 day, approved, written notice of the termination or restriction
  • landlord has to reduce the rent to compensate the tenant for loss / limitation of the non-essential service / facility

Essential Services may include, but are not limited to:

  • heat, hot water, electricity
  • elevator service
  • maintenance of public areas of the building
  • refrigerator, stove

A service or facility is not essential when:

  • tenant can obtain the service or facility or a reasonable substitute through an alternate source
